These Terms of Service govern access to www.wobblenok.com and purchases from Wobblenook. By using the store or placing an order, the customer agrees to these Terms and the policies incorporated by reference.
Store operator
Wobblenook is operated by Eduardo Glauber da Silva from Sarzedo, Minas Gerais, Brazil. The online store is hosted using Shopify's commerce platform.
Eligibility and adult purchases
The store is intended for adults. A person placing an order represents that the person is at least 18 years old or has reached the age of majority where the person lives and has legal authority to use the selected payment method. Products intended for children must be purchased and supervised by a responsible adult.
Product information and safety
We aim to describe and display products accurately. Colors, scale, and appearance may vary because of screens, photography, manufacturing changes, and product batches. Product measurements and age guidance should be reviewed before purchase.
An adult must follow all packaging instructions, warnings, assembly directions, age recommendations, and supervision requirements. Packaging must be removed safely before a child uses a product. Products containing small parts are not suitable for children below the stated age range.
Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may accept, reject, limit, or cancel an order for legitimate reasons, including unavailable inventory, pricing or description errors, suspected fraud, payment failure, shipping restrictions, or reseller activity inconsistent with normal personal use.
If we cancel an order after payment has been captured, we will issue a refund to the original payment method.
Prices payments and taxes
Prices are displayed in United States dollars unless otherwise stated. Applicable shipping charges, discounts, and taxes will be shown at checkout when required. Customers agree to provide current and accurate billing, payment, and contact information and authorize the applicable payment provider to process the transaction.
We may correct typographical, pricing, promotional, inventory, or product-information errors before or after an order is submitted. If a correction materially affects an accepted order, we will provide an appropriate option to confirm the change or cancel for a refund.
Shipping returns and refunds
The Shipping Policy and Return and Refund Policy form part of these Terms. Delivery dates are estimates. Ownership and risk are handled according to applicable law and the selected shipping arrangement. Nothing in these Terms removes consumer rights that cannot legally be waived.
Promotions
Discounts, coupon codes, gifts, contests, and other promotions may have additional terms. Unless stated otherwise, promotions cannot be combined, have no cash value, and may be modified or ended before an order is accepted, subject to applicable law. We will not retroactively change the price of an already accepted order except to correct an error with an appropriate customer remedy.
Customer accounts and communications
Customers are responsible for maintaining the confidentiality of account credentials and for activity conducted through their accounts. Notify us promptly of suspected unauthorized use. Customers must provide accurate contact information so we can send order and service communications.
Reviews and submitted content
If a customer submits a review, photograph, comment, suggestion, or other content, the customer grants Wobblenook a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that content for store operation and promotion, subject to applicable privacy choices. The customer confirms having the rights needed to submit the content. We may remove unlawful, misleading, infringing, abusive, or irrelevant content.
Acceptable use
The store may not be used to violate law; infringe intellectual property or privacy rights; transmit malicious code; scrape or interfere with store systems; impersonate others; submit false information; commit payment fraud; harass others; or attempt unauthorized access. We may restrict access or cancel abusive or fraudulent transactions where permitted.
Third party services and links
Parts of the store may rely on Shopify and other independent service providers. Third-party links and optional services are provided for convenience. To the extent permitted by law, Wobblenook is not responsible for the independent content, availability, or practices of third-party sites or services.
Intellectual property
The Wobblenook name, store design, graphics, photographs, product descriptions, and other original store materials are owned by or licensed to Wobblenook and may not be copied, republished, or commercially exploited without permission, except as allowed by law.
Disclaimer
The store and its content are provided on an as-available basis. To the maximum extent permitted by law, we disclaim warranties not expressly stated in these Terms. This disclaimer does not exclude any warranty, guarantee, or consumer remedy that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by law, Wobblenook will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the store. Where liability cannot be excluded, it will be limited only to the extent legally permitted. These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence where exclusion is prohibited, or mandatory consumer rights.
Indemnification
To the extent permitted by law, a customer agrees to indemnify Wobblenook against third-party claims arising from the customer's unlawful misuse of the store, violation of these Terms, or infringement of another person's rights. This section does not apply where prohibited by consumer law.
Governing law and disputes
These Terms are governed by the laws applicable in Minas Gerais, Brazil, without regard to conflict-of-law rules, except that customers retain the protection of mandatory consumer laws that apply where they live. Before filing a formal claim, the parties should attempt in good faith to resolve the issue by contacting wobblenok.toys@gmail.com. Any forum provision applies only where permitted by law.
Severability waiver and entire agreement
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. These Terms and the policies referenced in them constitute the agreement concerning use of the store and purchases, except for additional terms clearly disclosed for a specific service or promotion.
Changes to these terms
We may update these Terms by posting a revised version with a new last-updated date. Changes apply prospectively unless law requires otherwise. Continued use of the store after a change means acceptance of the revised Terms where legally valid.
